A lifting machine is a machine intended for lifting and shifting in space loads suspended on a hook or with the help of another suspension or lifting device.

The use of lifting machinery to move or transport loads involves a degree of risk to the safety of the persons operating the machine or other persons in the area where the machine operates, the materials and goods or the facilities located in the area . Depending on the degree of danger, the lifts are classified into the following categories:

* High risk, which is divided into two subcategories:

  • high 1 risk
  • high 2 risk,

* Average risk and

* Low risk

All lifting machines, regardless of the date of first installation and operation, are subject to periodic inspection.

The lifting machines, in accordance with article 4 of the Decree no. 15085/593 KYA (Government Gazette 1186/Β’/25.08.2003) “Regulation of Controls of Lifting Machines”, are subject to:

  1. In an initial test of Type AA with loads and within specific time frames as defined in the QIA, in order to ensure their correct installation and good operation when:
    – the lifting machines were installed and operated for the first time after 25/02/2004, or
    – the lifting machines were assembled, converted or underwent major repair after 25/02/2004 regardless of the date of first installation and operation,
  2. In Type B periodic retest (intermediate test without loads) and
  3. In Type A periodic retest (full test with loads),

All lifting machines must be re-certified after a period of time, which varies according to the hazard category to which they belong.

LEGISLATIVE FRAMEWORK OF LIFTING MACHINES

Since 1993, lifting machines that are manufactured, placed on the market, installed and operated are obliged to comply with the requirements of:

  • PD 57/2010 (Government Gazette 97/A’/25.06.2010) “Adaptation of Greek Legislation to Directive 2006/42/EC of the European Parliament and of the Council regarding machinery and the amendment of Directive 95/16/EC and abolition of the P.D. 18/96 and 377/93” and
  • the KYA under no. Government Decree 15085/593/25.08.2003 (Government Gazette 1186/B/2003) “Lifting Machinery Inspection Regulation” for the initial inspection and periodic re-inspection of lifting machinery.

OBLIGATIONS UNDER THE LAW

INITIAL DISPOSAL IN THE MARKET

In accordance with the requirements of PD 57/2010 (Government Gazette 97/A’/25.06.2010) “Adaptation of Greek Legislation to Directive 2006/42/EC of the European Parliament and of the Council regarding machinery and the amendment of Directive 95/ 16/EC and repeal of the P.D. 18/96 and 377/93”, lifting machines must:

  • to carry clear, legible and indelible markings that will provide at least the following information:
  • the trade name and full address of the manufacturer and, where applicable, of his agent,
  • the description of the machine,
  • the “CE” marking,
  • the description of the series or type,
  • the serial number if any,
  • the year of manufacture, i.e. the year in which the manufacturing process was completed
  • be accompanied, among others, by the following documents:
  • the EC Declaration of Conformity in the Greek language,
  • instructions for use in the Greek language,
  • drawings, diagrams, descriptions, etc., required for the use, maintenance and repair of the machine and for the verification of its correct operation.

Before placing the machine on the market and/or starting to use it, the manufacturer, or his authorized representative, or the importer in the case of an imported lifting machine from a third country outside the EU and makes it available under his name or his own trademark, ensures that:

  1. the machine meets the relevant health and safety requirements,
  2. the technical file is available,
  3. provides the necessary information, such as instructions for use, drawings, diagrams,
  4. applies the appropriate conformity assessment procedures,
  5. draws up the EC declaration of conformity and that this declaration accompanies the machine in any case,
  6. correctly affixes the CE marking.

For lifting machines manufactured after 1993, the manufacturer must provide the owner with the accompanying documents mentioned above (see point b).

For cases where the above documents cannot be retrieved from the manufacturer, for very substantial reasons (e.g. the manufacturer no longer exists, or the technical documentation is no longer available due to age, or the lifting machine was resold without being given to the new owner the required documents), the owner must reconstruct the technical documentation of the machine and carry out the necessary compliance procedures of the lifting machine. In these cases, the EC declaration of conformity is signed by the owner.

INITIAL & PERIODIC CHECK

All lifting machines, regardless of the date of first installation and operation, are subject to periodic re-inspection.

The lifting machines, in accordance with article 4 of the Decree no. 15085/593 KYA (Government Gazette 1186/Β’/25.08.2003) “Regulation of Controls of Lifting Machines”, are subject to:

ADDITIONAL REQUIREMENTS

In any case, in accordance with article 3 of Government Regulation No. 15085/593 KYA (Government Gazette 1186/B’/25.08.2003) “Lifting Machinery Inspection Regulation”, the lifting machinery must be accompanied by:

  • instructions for use and maintenance, which are provided by the manufacturer, and
  • maintenance and inspection book, in which any faults and how to deal with them are recorded and is kept by the owner.
